Indexed REC RFP – ANNOUNCEMENT: IPA Issues Guidance on Indexed REC Contract Renegotiation for Utility-Scale Projects

The Clean and Reliable Grid Affordability Act (“CRGA”) (Public Act 104-0458) was signed into law on January 8, 2026. Set to take effect on June 1, 2026, the CRGA contains new language addressing the potential for post-award renegotiation of certain non-price contract terms for select Indexed Renewable Energy Credit (“Indexed REC”) contracts for competitively bid utility-scale projects.

The Illinois Power Agency (“IPA”) has published a guidance document to help existing Indexed REC contract holders navigate non-price renegotiation options for their existing contracts, in light of the recently signed CRGA. The IPA hopes this guidance will provide clarity to parties participating in its Indexed REC procurement process in the months leading up to CRGA’s June 1, 2026, effective date and after.
